General Terms and Conditions (T&Cs) – ferienhausliebe
1. Scope of Application and Role of the Provider
1.1. ferienhausliebe (“Platform”) operates an online platform for the presentation and booking of selected holiday accommodations.
1.2. ferienhausliebe is not a tour operator and does not act as a legal representative of the host.
1.3. ferienhausliebe exclusively provides technical infrastructure as well as curated presentation and service offerings.
1.4. The accommodation contract is concluded exclusively between the guest and the respective host.
2. Services of ferienhausliebe
2.1. ferienhausliebe offers, in particular:
curated selection and presentation of accommodations
provision of the booking interface
forwarding of booking inquiries
technical support for payment processing via external payment service providers
2.2. ferienhausliebe is not obligated to provide accommodation services and assumes no obligations arising from the accommodation contract.
2.3. ferienhausliebe does not act as a representative of the host and does not make any independent legally binding declarations on behalf of the host.
3. Conclusion of Contract
3.1. By completing the booking process, the guest submits a binding offer to conclude an accommodation contract with the host.
3.2. The host decides whether to accept the booking.
3.3. ferienhausliebe can technically transmit the booking confirmation on behalf of the host.
3.4. In this regard, ferienhausliebe does not act as a representative in the legal sense, but exclusively as a technical transmitter of the host’s declaration.
3.5. The contract is concluded exclusively between the guest and the host. No further written declaration of acceptance or separate signing of the contract is required. The lodging contract is concluded as soon as the host expressly confirms the booking offer and the guest has made the initial payment due during the booking process by the deadline. The host’s booking confirmation may be transmitted technically by ferienhausliebe on behalf of the host. If the down payment option is offered in accordance with Section 5.6, successful payment of the down payment suffices as the initial payment due. The subsequent payment of the balance does not affect the accommodation contract that has already been concluded.
3.6. The listings of accommodations on the platform do not constitute a legally binding offer. A binding reservation is not created until the host has expressly confirmed the reservation and the initial payment due during the booking process has been successfully made.
3.7. Availability and Technical Transmissions
Despite careful maintenance of content, technical transmission errors, synchronization discrepancies, or short-term changes in availability and prices may occur in individual cases.
A reservation is therefore considered binding only after the host has expressly confirmed it and the initial payment due has been successfully made.
ferienhausliebe assumes no liability for technical errors outside its sphere of influence, particularly in connection with external calendar, payment, or booking systems.
4. Prices and Service Fee
4.1. The host sets the accommodation rate for their property. The total price displayed to the guest during the booking process is calculated on this basis and includes ferienhausliebe’s service fee, unless expressly stated otherwise.
4.2. A service fee is charged for bookings made through ferienhausliebe. It is currently 15% of the total price paid by the guest.
4.3. The Service Fee:
is paid by the guest,
is already included in the total price displayed during the booking process and
is clearly shown during the booking process.
4.4. The service fee represents compensation for the use of the platform as well as for the listing and other services provided by ferienhausliebe.
Example: If the host sets the accommodation price at €1,000.00, the total price for the guest is calculated as €1,176.47. Of this amount, €176.47 represents the ferienhausliebe service fee (15% of the total price) and €1,000.00 represents the accommodation price set by the host.
4.5. Visitor’s tax, security deposit, and local fees
If local tourism fees, a security deposit, visitor taxes, or similar charges apply, these are determined and collected by the respective accommodation provider.
Payment is made – unless otherwise specified – directly to the host on-site or as part of the booking process.
ferienhausliebe has no influence on the amount or the local legal requirements of these levies.
5. Payment Processing (Stripe / PSD2 Compliance)
5.1. Payment processing is handled exclusively through external payment service providers, specifically Stripe or Stripe Connect.
5.2. The host is the payee of the amount corresponding to the accommodation price set by the host. Ferienhausliebe is the payee of the service fee due in accordance with Section 4.
5.3. Ferienhausliebe does not accept or hold customer funds itself. Payments are processed through an external payment service provider, which distributes the respective payment amounts to the designated payees according to the specified payment breakdown.
5.4. ferienhausliebe is at no time a payment service provider within the meaning of PSD2 and does not provide any payment services requiring authorization.
5.5. Payments are processed exclusively through the payment service provider’s infrastructure.
5.6. Down Payment and Balance Due
The payment terms applicable to each booking are clearly displayed during the booking process.
If the deposit option is offered for the respective accommodation, the guest initially pays 20% of the total price shown during the booking process at the time of booking. The remaining 80% is generally due at the end of the free cancellation period applicable to the accommodation. If this date is less than 14 days before arrival, the remaining balance is due no later than 14 days before arrival.
The cancellation policy applicable to the accommodation remains unaffected by this.
For last-minute bookings made after the due date for the final payment, the full amount is due immediately.
The remaining payment will be requested through the payment service provider used by ferienhausliebe, specifically Stripe or Stripe Connect.
5.7. Payment Deadline and Failure to Pay the Remaining Balance
The deadline specified during the booking process or in the payment request applies to each payment due.
If a remaining balance due is not paid within 24 hours of the payment request, the guest will receive a payment reminder and an additional 24 hours to pay. If payment is not received even within this grace period, the reservation will be canceled and the reserved time slot will be made available again.
The consequences for payments already made are governed by the cancellation policy applicable to the reservation.
6. Withdrawal and Cancellation
6.1. Cancellation and refund policies are governed exclusively by the agreements in place between the guest and the host for the respective accommodation.
6.2. The applicable cancellation policy will be displayed during the booking process before the booking is finalized and also governs the handling of any deposits or other payments already made.
6.3. Ferienhausliebe assumes no responsibility for the content of the cancellation policy set by the host. The technical processing of payments and refunds is handled by the payment service provider used by Ferienhausliebe.
6.4. ferienhausliebe is entitled to technically cancel or annul bookings if this is necessary for legitimate reasons. These include, in particular, obvious technical errors, double bookings, incorrect price transmissions, inaccurate availabilities, or other circumstances that would make proper execution of the booking impossible or significantly impair the interests of the guest, the host, or the platform. Where possible, cancellation will be made in agreement with the host. Unless the guest is responsible for the cancellation, any payments already made through the payment service provider, including the service fee, will be refunded in full.
7. Obligations of the Guest
7.1. The guest is obliged to provide truthful information for all booking details.
7.2. The guest is obliged to comply with the house rules and conditions of the host.
7.3. Defects in the accommodation must be reported immediately to the host.
7.4. The execution of the stay and communication regarding accommodation, arrival, stay, and local services are generally handled by the host.
8. Liability of ferienhausliebe
ferienhausliebe is liable exclusively for intentional or grossly negligent breaches of duty within the scope of its own platform services.
Liability for services, stays, accommodations, or breaches of duty by the host is excluded.
Liability for slight negligence is excluded – except in the case of a breach of essential contractual obligations.
ferienhausliebe is not liable for restrictions or failures that are outside the platform’s sphere of influence, in particular natural events, official measures, failures of technical infrastructure, or other cases of force majeure.
9. Liability of the Host
9.1. The host is solely responsible for:
the proper execution of the stay,
the accuracy of the information regarding the accommodation, and
the fulfillment of all legal obligations.
10. No Travel Services within the Meaning of Package Travel Law
10.1. Ferienhausliebe does not offer package tours or linked travel arrangements as defined in Sections 651a et seq. of the German Civil Code (BGB).
10.2. No bundling of multiple travel services takes place.
11. Note on the Right of Withdrawal
11.1. Consumers generally have a statutory right of withdrawal for distance contracts.
However, for contracts for the provision of accommodation services for a specific date or period, there is no right of withdrawal in accordance with Section 312g (2) No. 9 of the German Civil Code (BGB).
11.2. The respective cancellation conditions of the accommodation can be found directly in the booking process and in your booking confirmation.
12. Data Protection and Communication
12.1. For the purpose of booking, relevant data is exchanged between the guest, host, and payment service provider.
12.2. Further information can be found in the privacy policy.
13. Final Provisions
13.1. German law applies.
13.2. The place of jurisdiction is – as far as legally permissible – the registered office of ferienhausliebe, Bremen.
13.3. Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.
